Terms of Use
These terms are the agreement between you and Swoop when you use the Swoop app or this website. A home swap means letting someone into your home and staying in theirs, so these terms say plainly what Swoop does and what you and the other member are responsible for.
The five things to know
- Swoop is not a party to your swap. The swap is an arrangement between you and the other member.
- No money changes hands between members. Asking for rent or a deposit is not allowed.
- Showing interest in a home needs Swoop Plus. Browsing and answering interest in your own home are free.
- You cancel Plus in the App Store or Google Play. See How to cancel Swoop Plus.
- If you're a consumer, you keep the protections of the law where you live, and you can take a claim to your local courts.
1. Who we are and how to reach us
Swoop ("we", "us") is run by its founder, an individual based in Israel. By creating an account or using Swoop, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Swoop.
Single point of contact. For members and for authorities, including under the EU Digital Services Act: support@swoop-homes.com, in English or Hebrew.
2. Words we use
- Member: anyone with a Swoop account.
- Home and listing: the place a member offers, and its page on Swoop.
- Swap: an arrangement between two members to stay in each other's homes (at the same time or at different times) or for one to host the other.
- Confirmed swap: a swap both members have confirmed in the app.
- Swoop Plus: the paid subscription described in section 10.
- Content: anything a member puts on Swoop: listings, photos, profile, messages, voice messages, reviews.
3. Your account
- You must be 18 or older. We close accounts that belong to minors.
- One account per person, and it's personal: don't share it or let anyone else use it. Keep your device and sign-in secure.
- The information you give must be true and kept up to date.
- You must verify a phone number before you publish a home or show interest in one.
- You can't use Swoop if we've banned you before, or if the law where you live prohibits it.
If you think someone else has access to your account, tell us straight away.
4. What Swoop is, and isn't
Swoop is a platform that helps members find each other and arrange home swaps. We provide the app: listings, matching, chat, and tools for agreeing dates.
Swoop is not a party to any swap. Swoop is not a landlord, letting or estate agent, travel agent, host or insurer, and doesn't own, manage, inspect or control any home. The rights and obligations between two members are set by what they agree and by the law that applies to them.
We check that every member who publishes a home or shows interest has verified a phone number, and we act on reports. The "verified" mark on a profile means only that: a verified phone number. It is not an identity, background or home check. We don't verify every listing, member or statement, and we can't promise that a home is as described, that it's safe, or that a member will behave well or keep to an agreement.
5. If you host
When you list a home, you confirm and agree that:
- You have the right to offer it. You own it, or your lease and landlord allow it. Where a mortgage lender, owners' association or building rules need to agree, they have.
- You follow the rules where your home is. Many places regulate short stays in private homes. Some, including a growing number in the EU, require registration or a permit, limit nights per year, or treat swaps like rentals. Finding out what applies and complying is up to you. Swoop can't tell you whether a swap is allowed in your area.
- Insurance is your responsibility. Swoop provides no insurance of any kind. Check with your insurer that your home is covered while guests stay, and arrange cover if not.
- Taxes are your responsibility. Some countries treat a swap as taxable or reportable.
- Long stays can create rights. In some countries a long stay can give a guest tenant-like protection. Check before you agree to one.
- Your listing is accurate and current. The photos are of this home and show it as it is now; the description, rooms, guests, amenities, house rules and availability are true.
- No cameras inside. Don't record guests with cameras or microphones inside the home. Tell your guest about any outdoor camera before the swap.
- Your house rules and keys. You set clear house rules and arrange how keys are handed over and returned.
6. If you stay
- Treat the home with care and leave it as you found it.
- Keep to the house rules and to the agreed dates and number of guests. Don't stay longer than agreed.
- You're responsible for the people who come with you, and to the host for damage you or they cause.
- Check your own travel insurance covers staying in someone else's home.
7. Agreeing, confirming and cancelling a swap
Everything about a swap is agreed between the two of you, in the chat. One of you proposes the dates, guests and type of swap; the swap is confirmed when the other member confirms it in the app. Before you confirm, agree clearly on dates, guests, keys, house rules, pets and plants, cleaning, a car if one is included, what happens if something is damaged or lost, and what happens if one of you has to cancel. We suggest a video call before you confirm, and keeping what you agree in writing in the chat.
When a swap is confirmed, each of you can open the other's exact address and map pin.
Cancelling. Either member can cancel a swap in the app before it's completed. A late cancellation can cause real problems for the other member, so cancel only if you must, and tell them as early as you can. Cancelling repeatedly or in bad faith can lead to limits on your account.
Damage and disputes. Swoop does not guarantee any home and does not pay for damage, loss, theft or cancellations. If something goes wrong, the two members settle it between them, or under the law that applies. We may look at what happened to decide whether someone broke these terms, but we don't decide who owes whom.
8. Your partner's privacy
Use your swap partner's address, door codes, phone number and other details only for that swap. Don't share them, and delete codes and notes you no longer need when the swap ends.
9. No money between members
Swaps on Swoop are not paid. The only thing anyone pays for is Swoop Plus, a subscription to the platform. You must not:
- ask for, offer or accept rent, a booking fee, a deposit or any other payment for a stay arranged through Swoop;
- use Swoop to advertise a paid rental or a business, or to find guests for one;
- take a conversation off Swoop to ask for money or payment details.
A request for money from someone you met on Swoop is the most common sign of a scam. Don't pay, and report it.
10. Swoop Plus
Browsing homes and answering members who are interested in your home are free. Showing interest in a home needs Swoop Plus, a monthly or annual subscription. Before you buy, the app shows what Plus includes, the price and the renewal period, as set in the App Store or Google Play. Plus doesn't guarantee that anyone will accept your interest or agree to a swap, and it doesn't move your listing up in anyone's feed.
- Payment and renewal. Apple or Google charges you. Plus renews automatically at the end of each period until you cancel. Price changes follow the store's rules, which ask you to agree before a higher price applies.
- Cancelling. Cancel at any time in your App Store or Google Play subscription settings; renewal stops and you keep Plus until the end of the period you've paid for. Step-by-step instructions are on How to cancel Swoop Plus. You can also email support@swoop-homes.com asking to cancel, and we'll cancel it for you or, where only the store can do it, walk you through it. Deleting your Swoop account does not cancel Plus.
- 14-day right of withdrawal. If you live in the EU or the UK, you can withdraw from your purchase within 14 days, without giving a reason. Because the purchase is made through Apple or Google, you do this through them: Apple at reportaproblem.apple.com, Google through your Google Play order history. Consumers elsewhere, including in Israel, keep the cancellation and refund rights their local law gives them.
- Refunds for purchases on Apple are made by Apple. For purchases on Google Play, you can ask Google, or ask us and we can refund through Google Play.
11. How homes are ranked
Your feed is ordered automatically. The main factors, from strongest to weakest: whether the home is in a country your travel plans name; whether the owner's travel plans name your country; whether your dates and the home's availability overlap, or either side is flexible; whether the home sleeps the number of guests you need; and how recently it was published. Your filters decide which homes appear at all. Homes you've already swiped on, members who've blocked you or whom you've blocked, and owners who haven't opened the app for 14 days are left out. No one can pay for a higher position: Swoop Plus doesn't affect ranking. Ratings don't affect it either.
12. Your content
Your listings, photos, profile, messages and reviews stay yours. So that we can run Swoop, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, display, adapt (for example resize) and share your content within the service, as described in the Privacy Policy. The licence ends when the content is deleted, except for messages the other member already received and reviews, which stay as described in the Privacy Policy. We'll use photos of your home in marketing outside the app only if you've given separate consent for that.
You confirm you have the right to share your content. The app removes location data from photos before upload, but please don't show valuables, safes, alarm systems, keys or children in your photos.
13. Rules of conduct
On Swoop you must not:
- list a home you don't have the right to offer, or one that doesn't exist;
- have more than one account, pretend to be someone else, or misrepresent who will stay;
- scam or defraud anyone, or try to get money, personal details or account access from a member;
- harass, threaten, discriminate against or abuse anyone, or send sexual content to someone who hasn't asked for it;
- post content that is illegal, hateful, violent, sexually explicit, or that infringes someone else's rights;
- share another member's address, details or messages outside Swoop without their permission;
- use a stay for anything illegal, for parties or events the host hasn't agreed to, or for commercial purposes;
- send spam, or use bots, scrapers or other automated means to access Swoop;
- get around our limits, the paywall, a block or a ban, or access data you're not allowed to see;
- interfere with the app, our servers or other members' use of Swoop.
14. Reporting and moderation
How to report. In the app, you can report a member, a home, a chat or a single message, and block anyone, from inside any chat. Anyone, member or not, can also report illegal content by email to support@swoop-homes.com. Please include where the content is (the member's name, the home, or a screenshot), why you think it's illegal or breaks these terms, and your name and email, unless you're reporting child sexual abuse material. We confirm we've received the report and tell you what we decided.
Who decides. Reports are reviewed by a person, not by software. The only automated tool is a word filter in the app: before a chat message is sent, it's checked on your phone against a list of offensive words, and you're asked to change it if there's a match. We don't restrict accounts automatically.
What we may do. Depending on how serious it is: a warning, removing content, hiding a listing, limiting features (for example, showing interest), suspending an account for a period, or closing it for good. A banned person may not open another account.
We tell you why. When we restrict your content or account, we send you a statement of reasons: what we restricted and for how long, the facts we relied on, which rule or law it breaks, that the decision was made by a person, and how to challenge it. We don't do this only when the law prevents it or it would put someone at risk.
Challenging a decision is free: reply to the statement or write to support@swoop-homes.com within six months, and someone who wasn't involved in the first decision, where possible, will look at it again. You can also go to court.
If we learn of anything suggesting a threat to someone's life or safety, we report it to the relevant authorities.
15. Safety
We don't run background checks. Before you confirm a swap, get to know the other member: read their profile and reviews, talk in the chat, and have a video call. In an emergency during a stay, call the local emergency number first. You can block or report anyone from inside the app.
16. Ending the agreement
You can delete your account at any time in the app (see Delete your account). Your home comes off Swoop straight away, your chats close, and any swap you've proposed or confirmed is cancelled, so tell the other member first. You have 30 days to change your mind by signing in again.
We may end our agreement with you, or close Swoop, with at least 30 days' notice, or straight away for a serious breach of these terms or the law. Confirmed swaps that are affected are cancelled, and we'll tell both members.
17. Liability
We work to keep Swoop running well and safely, but we can't promise it will always be available or free of errors. Because swaps happen between members, Swoop is not responsible for damage to a home, or for loss, theft or injury during a swap, or for how any member or guest behaves, online or offline.
Where the law allows, our total liability to you for any claim connected with Swoop is limited to the higher of what you paid for Swoop Plus in the 12 months before the claim arose and USD 100, and we aren't liable for indirect loss or loss of profit, data or opportunity.
If you live in the EU or the UK, the limits above don't apply. Instead, we're liable without limit for harm we cause intentionally or through gross negligence, and for death or personal injury we cause. For other harm caused by our ordinary negligence, we're liable only if we breach an essential obligation of this agreement, and then only for harm that was typical and foreseeable when you joined.
Wherever you live, nothing in these terms limits liability for death or personal injury caused by our negligence, for intent or gross negligence, for fraud, or for anything else the law doesn't allow us to limit.
If someone else makes a claim against Swoop because you broke these terms, you're responsible for the claim to the extent the law allows. If you're a consumer, this applies only where you were at fault.
18. Changes to these terms
We may change these terms only for a valid reason: a change in the law or a regulator's decision, to protect members' safety or security, to describe a new or changed feature, or to fix an error. We'll post the new version here with a new date and, for any change that affects you, tell you in the app or by email at least 30 days before it takes effect, unless the law or an urgent safety reason requires a shorter time. If you don't agree, you can delete your account before the change takes effect, and cancel Swoop Plus as described in section 10. If you keep using Swoop after the change takes effect, the new terms apply.
19. Governing law and courts
These terms are governed by the law of the State of Israel, and the competent courts in Israel can hear disputes. If you're a consumer, this choice of law doesn't take away the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country. If we need to bring a claim against a consumer in the EU or the UK, we'll do it in the courts where they live.
There's no compulsory arbitration and no waiver of class or collective actions for consumers. Please write to us first if something goes wrong; most things can be sorted out quickly.
20. App stores
If you downloaded Swoop from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. These terms are between you and Swoop, not Apple; Apple isn't responsible for the app or its support, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries. Google Play's terms apply to your use of Google Play.
21. General
- These terms and the Privacy Policy are the whole agreement between us about Swoop.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to a company that takes over Swoop, for example one set up by the founder to run it, and we'll tell you. Your rights won't be reduced by the transfer.
- These terms are written in English and in Hebrew. Both versions are binding.
